Terms of Service
1. Who we are
South Facing Garden is a trading name of Gulliver Consultations Ltd, a company registered in England and Wales.
- Company number: 16674246
- Registered office: 5 Lilly Lane, Chickerell, Weymouth, England, DT3 4FU
- Email: hello@southfacinggarden.co.uk
- VAT: Gulliver Consultations Ltd is not registered for VAT.
In these Terms, "we", "us" and "our" mean Gulliver Consultations Ltd. "You" means the person using the service.
2. About these Terms
These Terms apply when you use South Facing Garden through our website, our web app at app.southfacinggarden.co.uk, or our mobile apps (together, "the service").
They form the contract between you and us when you use our free features or buy report credits. Please read them before you buy. If you do not agree to them, please do not use the service.
The contract is made in English.
3. What the service is
South Facing Garden provides property information reports for residential addresses in England, Scotland and Wales. Addresses in Northern Ireland are not currently supported.
A report brings together information about a property and its surroundings in 13 categories, such as garden direction and estimated sunlight, flood risk, crime, schools, transport, broadband and mobile coverage, energy performance, council tax, sold prices and an automated value estimate, planning, listed buildings, air quality and local amenities.
Reports combine our own analysis with information from government and open data sources and from commercial data suppliers.
Reports contain information and estimates. They are not professional advice. A report is not a survey, a valuation for lending or sale, a legal search, or surveying, legal, financial or conveyancing advice. See section 10.
4. Free features
You can use these without an account, an email address or payment details:
- Free postcode preview. When you search for a postcode and house number or name, we show free information about the postcode area from public sources, such as the local authority, recorded sales in the postcode, modelled air quality and nearby flood information. It describes the area around the postcode, not the property you searched for, and the exact address is not confirmed until you generate a report.
- Free sample report. You can explore a complete sample report for a fictional property. Its data is illustrative and does not describe any real home.
A full report for a property needs a report credit (section 5). We no longer give a free full report to each device. If your device viewed a free property report before this change, you can still reopen that property's report without charge on the same device.
We may refuse or limit the free features where we reasonably believe they are being misused, for example by automated requests.
5. Reports and credits
5.1 What you can buy. You can buy either:
- a single report: 1 report credit for £1.19; or
- a report pack: 10 report credits for £7.99 in total.
Each is a one-off payment. Neither is a subscription and neither renews. Prices are in pounds sterling. We are not registered for VAT, so no VAT is added. There are no delivery or other charges.
5.2 Credits never expire. Purchased credits that you have not used never expire. Section 14 explains what happens if we ever close the service.
5.3 How credits are held. When you buy on our website or web app, your credits are held against the email address you give at checkout. To use your credits on another device or browser, choose "Restore access" and enter that email address; we send a one-time code to confirm it is you. Please keep your email account secure and tell us if you lose access to it.
5.4 Credits are personal. Credits are for your own use. They cannot be sold or transferred to another person and have no cash value, other than any refund you are entitled to under these Terms or by law.
5.5 Price changes. We may change the price or contents of what we offer for sale in future. A change never affects credits you have already bought.
6. How credits are used
- One credit is used when a report is generated for a property you have not already unlocked.
- Reopening a property you have already unlocked does not use another credit. This includes a property you viewed with a free report on the same device before free reports were withdrawn, which is carried into your account when you buy.
- If we cannot produce a report, for example because a data supplier is unavailable or the address cannot be matched, no credit is used.
- Some individual sections of a report may be unavailable for a particular address. A credit is still used where the report itself is generated. If you think a report was materially incomplete, contact us (see section 9).
- When you reopen a property, the report is produced again and may use newer data than before, so figures can differ from an earlier view. See section 11.
7. Buying a pack on our website or web app
7.1 Before you pay. In the purchase window we show you what you are buying, the total price, your right to cancel, and links to these Terms and to our Privacy Policy. We ask you to tick two boxes:
- one to ask for your credits to be added to your account straight away, before the 14-day cancellation period ends; and
- one to agree to these Terms.
The button that takes you to payment shows the price of what you have chosen: "Pay £1.19" for a single report or "Pay £7.99" for a report pack. Ticking the first box is a request only. It does not take away your right to cancel (see section 8).
7.2 Payment. Payment is taken by our payment provider, Stripe, on its secure checkout page, by debit or credit card or another payment method shown there. We do not receive or store your full card details.
7.3 When the contract is made. Your contract with us for a single report or a report pack is made when your payment is confirmed. Your credits are then added to your account straight away.
7.4 Confirmation. We email you a confirmation of your purchase. It sets out what you bought, the price, the date, what you confirmed at checkout, your right to cancel and how to use it, and the version of these Terms that applies. Please keep it. If it does not arrive, check your junk folder and then contact us.
7.5 A copy of these Terms. Each version of these Terms has a version number. The version that applies to a purchase is recorded with it and named in your confirmation email, and we keep a copy of every version.
7.6 Our mobile apps are covered by section 13.
8. Changing your mind: cancellation and refunds
This section sets out your right to cancel a pack bought on our website or web app, and our refund policy. It does not replace or reduce any other rights the law gives you.
8.1 Your right to cancel. You have the right to cancel your purchase of a single report or a report pack within 14 days without giving any reason. The cancellation period ends 14 days after the day you bought it.
8.2 If you have not used any credits: a full refund. If you cancel within the 14 days and none of the credits from that purchase have been used, we refund the full price you paid.
8.3 If you have used some credits. At checkout you ask us to add your credits straight away, during the cancellation period. Doing so does not take away your right to cancel. If you cancel within the 14 days after using one or more credits from that purchase, we will review your request individually and deal with it in line with your consumer rights. Any amount we keep will be no more than a proportionate amount for the credits you have used (for a report pack, one tenth of the pack price for each credit used; a single report's credit is used once its report has been generated), and you will never receive less than the law entitles you to.
8.4 After the 14 days. After the cancellation period has ended you no longer have this right to cancel. Your rights if something is wrong continue to apply (section 9), and so does section 14 if we change or close the service.
8.5 How to cancel. Tell us your decision in a clear statement:
- Email hello@southfacinggarden.co.uk. You can also reply to your purchase confirmation email.
- Write from, or quote, the email address you used to buy, and tell us the date of purchase if you can.
- Say clearly that you want to cancel. You may use the cancellation form at the end of these Terms, but you do not have to.
You have cancelled in time if you send your message before the cancellation period ends. We will confirm that we have received it, check how many credits from that purchase have been used, and tell you the outcome.
Refunds are made by us once we have reviewed your request. There is no automatic refund button in the app.
8.6 How refunds are paid. We make the refund without undue delay, and in any event no later than 14 days after the day you tell us you are cancelling. We refund to the payment method you used, unless you expressly agree otherwise. We do not charge a fee for a refund.
8.7 What happens to your credits. When a purchase is refunded, the unused credits from that purchase are removed from your account. Reports you have already opened are not affected by a refund of unused credits.
8.8 Payment disputes. If you ask your bank or card provider to reverse a payment, the unused credits from that purchase may be withheld while the dispute is open. If the dispute is decided in our favour they are returned to your account. Please contact us first; it is usually quicker.
8.9 Purchases through Apple or Google. See section 13.
9. If something is wrong, or you need help
We must provide the service with reasonable care and skill, and what we supply must be as described. You have legal rights if it is not. Depending on the problem, these can include having it put right, a repeat of the service, or a price reduction or refund.
What to do. Email hello@southfacinggarden.co.uk and tell us:
- the email address on your account, if you have bought a pack;
- the property address the report was for; and
- what went wrong.
What we will do. We will look into it and, where appropriate, regenerate the report, return the credit that was used, or refund you.
Nothing in these Terms removes or limits your statutory rights as a consumer. For free, independent advice about your rights you can contact Citizens Advice.
10. Accuracy, estimates and limits of the service
Please read this section carefully.
- Reports contain estimates. The property value shown is an automated estimate, not a formal valuation. Garden direction is an estimate and may occasionally be wrong or unavailable, particularly for unusual plots. Sunlight hours are estimates based on direction, location and time of year; they do not measure trees, fences or other local obstructions.
- Information comes from third parties. Much of the information in a report comes from government, open and commercial sources. It may be incomplete, out of date or wrong for a particular address, and coverage varies across Great Britain. Where a section cannot be provided, the report says so.
- Information has a date. A report reflects the data available when it was generated. Circumstances and source data change.
- It is not professional advice. A report is not surveying, valuation, legal, financial or conveyancing advice. Do not rely on a report alone when deciding whether to buy, sell, rent or lend against a property. Always obtain appropriate professional advice, such as a survey, a valuation, legal searches and conveyancing advice, and check important matters yourself, including by visiting the property.
11. Reports, saved properties and shared links
- Reports are generated on request. We do not keep a permanent copy of each report. Your right to reopen an unlocked property does not expire, but each time you open it the report is produced from current data.
- Licensed data is time limited. Some suppliers limit how long their data may be kept in a report. For that reason, parts of a saved or shared report may be removed after a period and the report may need to be reopened.
- Saved properties are bookmarks stored in your own browser or app. They are not stored on our servers and will be lost if you clear your browser data. Their details may be shortened after 90 days.
- Shared links. You can create a link to share a report. Anyone who has the link can open it, so share it only with people you trust. A shared link stops working no later than 90 days after the report was generated. Shared links are for personal sharing and must not be published or used commercially.
12. Subscriptions bought before report packs were introduced
We no longer sell unlimited subscriptions.
If you bought a subscription before it was withdrawn, we will honour it: you keep unlimited access until the end of the period you have paid for. When your subscription ends you can continue to use the free features and buy single reports or report packs.
If your subscription was bought through the Apple App Store or Google Play, it is billed and managed by Apple or Google, and you can view or cancel it in your Apple or Google account settings.
If you hold a subscription and also buy a report pack, your credits are kept separately and are not affected when the subscription ends.
13. Our mobile apps, and purchases through Apple or Google
Reports cannot currently be bought inside our iOS and Android apps, and we do not sell new subscriptions in them. If we introduce purchases in the apps, we will update these Terms first.
If you bought a subscription in one of our apps before subscriptions were withdrawn:
- payment was taken by Apple or Google, not by us, under their terms of sale;
- refunds of those payments are generally requested from, and decided by, Apple or Google under their refund policies. If you contact us we will help where we can; and
- your legal rights in relation to the service itself are not affected.
Sections 7 and 8 describe purchases made on our website or web app, where payment is taken through Stripe and we handle refunds ourselves. If you are unsure how you paid, contact us and we will tell you.
14. Changes to the service, and closure
14.1 Changes. We may change the service from time to time, for example to add or remove report categories, change data suppliers, or meet legal or licensing requirements. We will not make a change that materially reduces what you have already paid for without good reason, and if we do we will tell you in advance where we reasonably can.
14.2 Interruptions. The service may occasionally be unavailable, for example for maintenance or because a supplier is unavailable. No credit is used when a report cannot be produced.
14.3 If we close the service. If we decide to close the service permanently, or to stop honouring report credits, we will:
- give you as much notice as we reasonably can, by email where we hold your address and by a notice in the service; and
- refund purchased credits you have not used, where it is reasonably possible for us to do so, in proportion to the price you paid for them. Where we can, we will refund to the payment method you used; if that is no longer possible we will contact you at your account email address to arrange it.
This is subject to applicable law and does not affect any other rights you have in law if we stop providing the service.
15. Acceptable use
The service is for your personal, non-commercial property research. You must not:
- use the service, or allow it to be used, for a business purpose without our written agreement;
- resell, sublicense, republish or commercially distribute reports, shared links or the data in them;
- copy or extract data in bulk, or use automated tools, scripts or scrapers to access the service;
- try to obtain reports without the required credit, or to get around limits on free features or searches;
- interfere with the security or operation of the service; or
- use the service unlawfully or to harass or harm another person.
Estate agents, mortgage brokers, surveyors and other property professionals may use the service for their business only under a separate agreement with us.
If you seriously or repeatedly break these rules we may suspend or end your access. We will tell you why, unless the law prevents us. If we end your access and you have not broken these Terms, we will refund your unused purchased credits.
16. Intellectual property and data supplier restrictions
The South Facing Garden name, logo, design, software, scoring and written content belong to us or our licensors.
Data in reports belongs to the organisations that supply it and is provided to us under licence. These include Chimnie, Ordnance Survey, Royal Mail, HM Land Registry, Ofcom, the Environment Agency, Historic England, Mapbox and its imagery providers, ShadeMap and others. The current list of sources, with their acknowledgements, is in the "Data sources & licences" section of the app.
Our suppliers' licences limit what may be done with their data. For that reason:
- you may view, download and print reports for your own personal use only;
- you must not copy, extract, republish, sell or redistribute supplier data, or use it to build or add to a database, a mailing list or another product or service;
- you must not remove or alter a supplier's copyright notice or acknowledgement;
- some supplier data is kept in a saved or shared report only for a limited time (see section 11); and
- we may need to change or remove a data source if a supplier changes its licence or stops supplying us.
17. Our responsibility to you
- What we are responsible for. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or of our failing to use reasonable care and skill. Loss is foreseeable if it is obvious that it will happen, or if both we and you knew it might happen when the contract was made.
- What we are not responsible for. We are not responsible for loss or damage that is not foreseeable, or that is caused by events outside our reasonable control.
- Using reports for the wrong purpose. A report is a research aid (section 10). We are not responsible for loss that results from relying on a report in place of the professional advice section 10 says you should obtain, except to the extent the loss was caused by our own failure to use reasonable care and skill.
- Third-party data. We choose our sources with reasonable care, but we do not create or check the underlying data and cannot promise it is correct for every address.
- Personal use. We provide the service for domestic and private use. We have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
- What we never exclude. We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory consumer rights, or for anything else the law does not allow us to exclude or limit.
18. Complaints and support
For help, or to make a complaint, email hello@southfacinggarden.co.uk.
We aim to reply within two working days. This is a target, not a guarantee, and it does not affect your legal rights or any time limit the law sets.
If you are not satisfied with our response, tell us and we will review it. You can get free, independent advice about your consumer rights from Citizens Advice (citizensadvice.org.uk).
19. Your personal information
Our Privacy Policy explains what personal information we collect and how we use it, including cookies and analytics.
20. Changes to these Terms
We may update these Terms, for example to reflect changes in the law or in the service. The version number and effective date are shown at the top.
- The Terms in force when you buy a pack apply to that purchase, unless a later change is required by law or is to your benefit.
- If we make a material change that affects you, we will tell you by email where we hold your address, or by a notice in the service, before it takes effect.
21. General
- If a court finds part of these Terms unenforceable, the rest continue to apply.
- If we do not enforce a right straight away, we can still enforce it later.
- We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights. You may transfer your rights only if we agree in writing.
- This contract is between you and us. No one else has rights to enforce it.
22. Governing law and where you can bring a claim
These Terms are governed by the law of England and Wales. You also keep the protection of any mandatory consumer law of the part of the United Kingdom where you live.
You can bring legal proceedings in the courts of England and Wales. If you live in Scotland you can also bring proceedings in the Scottish courts, and if you live in Northern Ireland, in the Northern Irish courts.
